Membership Documents

Waiver / liability release

This Membership Agreement ("Agreement") is between 31FlavorFitness ("Facility") and the undersigned member ("Member"). By signing this Agreement, Member agrees to follow all terms outlined below in connection with participation in the 31FlavorFitness 3-Tier Membership System.

1. Membership Selection
The membership term begins on the date of the first successful payment and will continue on a month-to-month basis unless otherwise specified by tier selection. The agreement remains active until terminated by either party under the terms outlined in Section 4.
Member has chosen the following membership tier:
  • And It Begins – $80/month
    • 1 31Flavor Training Pod
    • 3x/week group classes
    • Monthly Trainerize program access
  • Let’s Go – $110/month
    • Access to 2 31Flavor Training Pods
    • Unlimited group classes
    • Monthly goal tracking and progress metrics
  • Lights, Camera, Action – $150/month
    • Access to all 4 Training Pods
    • Unlimited classes
    • One-on-one coaching review + adjustments monthly via Trainerize
All membership dues are billed monthly via auto-draft. If a payment fails, there will be up to three automatic retry attempts. After the third failed attempt, a $10 late fee will be applied for each additional attempt. Additional attempts will be made once every two weeks for one month. If payment is not received by the end of this period, the account may be forwarded to collections.. Late or missed payments may result in suspended access.

2. Member Access & Benefits
  • Members receive access to 31Flavor Training Pods as designated by tier
  • Group class access and Trainerize app access depend on selected membership tier
  • Classes must be booked in advance when space is limited

3. Member Responsibility
  • Member agrees to follow pod-specific training programs and class guidelines
  • Member affirms they are in good health and able to participate in structured exercise
  • 31FlavorFitness is not liable for injuries sustained while training, in classes, or while using equipment

4. Cancellation & Commitment
  • Memberships are month-to-month and may be canceled with 30 days’ written notice.
  • In the event of a medical condition or relocation of more than 50 miles from the facility, members may request a freeze of their account for up to 3 months. Depending on the situation, cancellation may be granted at the discretion of the Facility with appropriate documentation.
  • Upgrades/downgrades may be made with one billing cycle’s notice
  • No refunds for unused access, missed sessions, or partial months

5. Rules & Conduct
  • No sharing of pods or app access with non-members
  • Clean equipment after each use
  • Respect staff, trainers, and other members
  • Failure to comply may result in membership termination

6. Waiver & Release
Member agrees to hold 31FlavorFitness, its trainers, and representatives harmless for any injury, loss, or damage sustained in connection with training activities. This waiver covers participation in all on-site and Trainerize-delivered services.

8. Access Hours & Supervision
  • Member acknowledges that access to the facility is limited to designated hours and understands that the facility may be unsupervised at times. Member assumes full responsibility for their own safety during these periods.

9. Photo & Video Release
  • Member grants permission to 31FlavorFitness to use photographs or video footage taken during workouts or events for promotional purposes, unless the Member provides written notice opting out.

10. Code of Conduct / Zero Tolerance
  • Verbal abuse, discrimination, harassment, intimidation, or unsafe behavior toward staff or other members will result in immediate suspension or termination of membership without refund.

11. Changes to Terms, Continuity Disclaimer, and Contact Updates
  • 31FlavorFitness reserves the right to update this agreement and its membership terms with 30 days’ notice via email or posting in the facility. Continued use of the facility constitutes agreement to the updated terms.
  • In the event that 31FlavorFitness discontinues operations or significantly changes its programming or service offerings, members will be notified in writing. No refunds shall be issued for partial months or unused services unless required by local consumer protection laws. Memberships will be terminated without further obligation beyond the final billing cycle, unless otherwise agreed in writing.
  • Members are responsible for providing and maintaining accurate contact information, including email and mailing address. Failure to receive communications due to outdated contact details does not absolve Member from agreed-upon terms and policies.

12. Emergency Contact Authorization

13. Entire Agreement
This document constitutes the entire agreement between the parties. No verbal agreements or outside representations are binding unless included in writing and signed by both parties.

31Flavor Reset – Membership Agreement & Liability Waiver

PLEASE READ CAREFULLY BEFORE ACCEPTING

This Membership Agreement, Liability Waiver, and Assumption of Risk (“Agreement”) is entered into between 31FlavorFitness / 31Flavor Reset (“Company,” “we,” “us”) and the undersigned participant (“Participant,” “you”).

By enrolling in 31Flavor Reset, you acknowledge and agree to the terms below. This agreement is legally binding and applies to all participation in the program.


1. Program Description

31Flavor Reset is a guided behavior-change and fitness support system designed to improve long-term consistency, movement habits, and lifestyle structure. The program emphasizes sustainable behavior development over short-term or outcome-based results.

31Flavor Reset is not a medical program and does not provide medical diagnosis, treatment, rehabilitation, or guaranteed results.


2. Enrollment Fee (Non-Refundable)

A one-time enrollment fee of $120 is required to join 31Flavor Reset.
This fee covers onboarding, system access, and the physical 31Flavor Reset product.

The enrollment fee is non-refundable, except in the following cases:

  • Verified medical inability to participate (documentation from a licensed physician required), or

  • Death of the participant.


3. Monthly Subscription

The monthly subscription fee is $19.99 per month.

  • Billing begins at enrollment and continues on a month-to-month basis

  • Fees are billed automatically through the designated billing platform

Subscription includes:

  • Two (2) 30-minute coaching or guidance sessions per month

  • Weekly system messaging and accountability support

  • Participation in the 31Flavor Reset framework and challenges

  • Optional nutrition guidance that is educational only and non-medical


4. Additional Sessions

  • Additional sessions may be purchased at $10 per session

  • Sessions are subject to availability and must be scheduled in advance

  • Additional sessions do not roll over and are not guaranteed


5. Scheduling, Rescheduling & Missed Sessions

  • Sessions must be scheduled in advance within available time slots

  • Sessions may be rescheduled with at least 24 hours’ notice

  • Sessions canceled with less than 24 hours’ notice are forfeited

  • Missed sessions are not refunded, rescheduled, or carried forward


6. Cancellation Policy

  • Membership is month-to-month

  • A 30-day written notice is required to cancel

  • Billing continues during the 30-day notice period

  • No refunds are provided for unused time, sessions, or partial months


7. Freeze Policy

  • Membership freezes are not automatic

  • Freeze requests require approval by the founder

  • Maximum freeze duration is two (2) months

  • Extensions may be granted at founder discretion

During a freeze:

  • Billing may be paused (platform dependent)

  • Sessions do not accrue

  • System access may be limited


8. Participant Responsibility

You acknowledge that:

  • You are responsible for your own participation, effort, and decisions

  • Results are not guaranteed

  • Weight loss timelines or outcomes are not promised

  • Weigh-ins do not occur until later phases of the program

  • 31Flavor Reset provides structure and accountability, not personal responsibility


9. No Medical Advice

31Flavor Reset does not provide medical advice, physical therapy, or medical nutrition therapy.

Any nutrition or lifestyle guidance provided is general educational information only. You are responsible for consulting a licensed healthcare provider before participating if you have any medical conditions, injuries, or concerns.


10. Assumption of Risk

You understand that participation in fitness activities and lifestyle changes involves inherent risks, including but not limited to physical injury, illness, or adverse health outcomes.

You voluntarily assume all risks associated with participation and acknowledge that you participate at your own risk.


11. Release of Liability

To the fullest extent permitted by law, you agree to release, waive, and hold harmless 31FlavorFitness / 31Flavor Reset, including its owners, coaches, employees, contractors, and affiliates, from any and all claims, injuries, damages, or liabilities arising from or related to participation in the program, including claims based on negligence, except where prohibited by law.


12. Communication Consent

By enrolling, you consent to receive:

  • Program-related messages

  • Session reminders

  • Educational communications

Communication may occur via text, email, or app-based platforms. Personal information is not sold or shared.


13. Platform & Billing Terms

Billing is processed through Gymdesk or an alternative billing platform if necessary. You agree to comply with all applicable platform billing and payment terms in addition to this agreement.

I understand that results are not guaranteed
I voluntarily assume all risks associated with participation
I agree to the cancellation, freeze, and refund policies

You may opt out of non-essential communications at any time.

5. How We Protect Your Information
We take reasonable steps to protect your information, including:
  • Using secure platforms for payments and scheduling

However, no system is completely secure, and we cannot guarantee absolute security.

6. Third-Party Services
